These Terms and Conditions (“Terms”) govern your use of the website https://mitaebeauty.com and your purchase of products from Mitae (“we”, “us”, “our”), whether you are located in India or in any other country. By accessing or using the Site, you agree to be bound by these Terms.

If you do not agree to these Terms, you must not use our Site or purchase products from us.

1. Eligibility

  • You must be at least 18 years of age and capable of entering into a legally binding agreement to use this Site and place orders.
  • By using the Site, you represent and warrant that you meet these eligibility requirements.

2. Use of the Site

You agree to:

  • Use the Site only for lawful purposes and in accordance with these Terms.
  • Not attempt to interfere with the proper working of the Site, including by introducing viruses, malware, or harmful code.
  • Not engage in any activity that could damage, disable, overburden, or impair the Site or our systems.

We reserve the right to suspend or terminate your access if we believe you have violated these Terms.

3. Territory and International Customers

We ship products to customers in India and selected international destinations listed at checkout or on our Shipping Policy page. By placing an international order, you confirm that:

  • The products may be lawfully imported into your country; and
  • You are the importer of record, responsible for complying with all applicable local laws and regulations, including cosmetic product regulations, import restrictions, and customs rules.

4. Product Information

  • We strive to display product descriptions, ingredients, images, and prices accurately; however, errors may occur.
  • Colours may appear differently on different screens and devices, and we cannot guarantee that your device will display colours accurately.
  • We reserve the right to modify or discontinue any product at any time without prior notice.

5. Pricing, Currencies, Orders, and Payments

  • All prices on the Site are shown in Indian Rupees (INR) by default; for some regions, prices may be displayed in local currencies for your convenience.
  • We reserve the right to change product prices at any time without prior notice; the price applicable to your order will be the one displayed at checkout at the time of purchase.​
  • By placing an order, you are making an offer to purchase the selected products, subject to these Terms.
  • We reserve the right to accept or reject your order, in whole or in part, for reasons including product unavailability, errors in product or pricing information, or suspected fraud.​
  • Payment must be made through the available payment methods on the Site (for example, UPI, credit/debit cards, net banking, wallets, and international payment methods displayed at checkout).

If an order is cancelled after payment is received due to our error or product unavailability, we will initiate a refund in accordance with our Refund Policy.

6. Duties, Taxes, and Customs (International Orders)

For international orders, the total price at checkout may exclude or include estimated import duties, taxes, and fees depending on the option shown at checkout (Delivered Duty Paid or Delivered Duty Unpaid).

  • If duties and taxes are not collected at checkout (DDU), you are solely responsible for paying all such charges directly to the carrier or customs authority upon import.
  • If duties and taxes are collected at checkout (DDP, where available), we or our partners will attempt to remit these amounts to the appropriate authorities on your behalf; any difference due to local assessment is outside our control.

Customs policies vary widely from country to country, and you should contact your local customs office for more information before placing an order.​

7. Shipping and Risk of Loss

Shipping and delivery of products are governed by our separate Shipping Policy, which forms part of these Terms.

Title and risk of loss for products pass to you when we hand over the order to the carrier. For international shipments, any delays or holds due to customs clearance are outside our control, and we will not be liable for such delays.

8. Returns, Replacements, and Refunds

Our Returns & Refunds Policy forms part of these Terms. Please review the Returns & Refunds Policy before making a purchase to understand the conditions applicable to returns, replacements, or refunds for both domestic and international orders.

9. Intellectual Property

All content on the Site, including text, logos, images, graphics, product photos, icons, and software, is the property of Mitae or its licensors and is protected under applicable intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any content from the Site without our prior written consent.

10. User Content

If you submit any reviews, comments, feedback, photos, or other content (“User Content”) on the Site or our social media:

  • You grant us a non‑exclusive, royalty‑free, worldwide, perpetual licence to use, reproduce, modify, publish, and display such User Content in connection with our business.​
  • You represent that you own or otherwise control all rights to the User Content and that it does not infringe any third‑party rights or contain defamatory, offensive, or unlawful material.​

We may remove or edit User Content at our discretion.

The Site may contain links to third‑party websites or services that are not owned or controlled by us. We are not responsible for the content, privacy policies, or practices of any third‑party websites or services, and you access them at your own risk.

12. Limitation of Liability

To the fullest extent permitted by law:

  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or purchase of products.
  • Our total liability for any claim, whether in contract, tort, or otherwise, shall be limited to the amount you paid for the product giving rise to the claim.

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law.

You agree to indemnify, defend, and hold harmless Mitae, its directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses arising out of or related to your use of the Site or violation of these Terms.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising in connection with these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts located in Mumbai, Maharashtra, India.​
